Prima Wawona receives extension of exclusive plan periods

By Sarah Lizee

Olympia, Wash., Feb. 26 – MVK FarmCo LLC (Prima Wawona) received an extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to an order filed Monday with the U.S. Bankruptcy Court for the District of Delaware.

The court extended the exclusive plan filing period through May 13 from Feb. 12 and the exclusive solicitation period through July 9 from April 10.

The debtor has filed a plan and disclosure statement, and the confirmation hearing is scheduled for March 27.

“Extension of exclusivity periods is critical to the debtors’ efforts to obtain global support of a value-maximizing plan without the risk of substantial disruption and additional costs that could stem from the introduction of new plans, proposed by creditors seeking to advance their parochial interests,” the company said in the extension motion.

Prima Wawona is a Fresno, Calif.-based producer of stone fruit. The company filed bankruptcy on Oct. 13 under Chapter 11 case number 23-11721.
