Nashville Senior Care secures another exclusivity extension

Olympia, Wash., April 1 – Nashville Senior Care, LLC secured another extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to an order filed Monday with the U.S. Bankruptcy Court for Middle District of Tennessee.

Specifically, the court extended the exclusive plan filing period through April 15 and the exclusive solicitation period through May 17.

The company said the debtors have been working with their primary constituencies on a plan of liquidation that would become effective after the closing of the sale of its assets.

The debtors have been in discussions with indenture trustee UMB Bank, NA, the official committee of unsecured creditors and the U.S. trustee overseeing the case regarding the plan.

More recently however, the debtors have been focused on litigation with Nexus Capital XIII LLC, the company said. As a reminder, the debtor was set to sell assets to Nexus, but later shifted to a sale to Cascasis LLC.

“Now that the debtors believe those issues are resolved in principle, and the debtors will be working with Cascasis toward a closing of the sale, among other related issues,” the company said in the motion.

The Hermitage, Tenn.-based senior care company filed bankruptcy on Aug. 14, 2023 under Chapter 11 case number 23-02924.
