Tru Grit’s motion for more time to file financials draws objection

Olympia, Wash., Jan. 5 – Tru Grit Fitness LLC’s motion seeking an extension of the deadline to file schedules and statements to Jan. 20 drew an objection on Wednesday from Region 17 U.S. trustee Tracy Hope Davis, according to court documents filed with the U.S. Bankruptcy Court for the District of Nevada.
Though the company has filed several pleadings since it entered Chapter 11, it still hasn’t filed documents the U.S. trustee needs to review before conducting an initial creditor meeting.
“The debtor has failed to carry its burden, by the mere fact they were able to file fifteen lengthy substantive pleadings while enjoying the protections afforded them under the bankruptcy code, including protection of the automatic stay, but failing to timely file the schedules and [statements of financial affairs],” she said in the objection.
The U.S. trustee said creditors will be prejudiced due to the debtor’s delay and there will be no meaningful opportunity to examine the debtor under oath at the initial meeting.
She added that granting an extension would effectively eat into any time for a creditor to accurately complete and file a proof of claim.
Tru Grit is a Las Vegas-based professional fitness equipment company. The company filed bankruptcy on Dec. 7 under Chapter 11 case number 22-14320.
