Edgemere’s unsecured creditors committee files suit over UMB liens

Olympia, Wash., July 13 – The official committee of unsecured creditors of Northwest Senior Housing Corp., which does business as Edgemere Dallas, filed a complaint against prepetition and debtor-in-possession financing lender UMB Bank, NA, according to court documents filed with the U.S. Bankruptcy Court for the Northern District of Texas.

The committee filed the adversary proceeding to determine the validity, extent and priority of liens on property of the estate of the debtors.

Specifically, the committee said it brought the suit to avoid the unperfected liens asserted by UMB in its capacity as bond trustee and master trustee under certain bond documents and to seek a declaration that the unperfected collateral belongs to the debtors’ bankruptcy estates unencumbered by any liens in favor of UMB.

The group said Edgemere has confirmed that is won’t pursue any such challenge.

The Dallas-based luxury senior living community filed Chapter 11 bankruptcy on April 14 under case number 22-30659.
