Ector County Energy gets extension of exclusive plan periods

Olympia, Wash., Sept. 12 – Ector County Energy Center LLC received an extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to an order filed Friday with the U.S. Bankruptcy Court for the District of Delaware.

Specifically, the court extended the plan filing period through Sept. 30 and the solicitation period through Nov. 30.

The company filed bankruptcy to facilitate a sale of its assets. The company closed the $144.75 million sale of its asset to Rockland Capital, LLC on July 13.

With the sale closed, the company then focused on preparing to file a proposed plan, so that the net sale proceeds and other cash assets can be distributed to creditors.

In conjunction with filing the plan and related disclosure statement, the company filed the exclusivity motion.

The disclosure statement hearing is scheduled for Oct. 4.

Goldsmith, Tex.-based Ector owns and operates a 330 MW natural gas-fired electricity-generating facility. The company filed Chapter 11 bankruptcy on April 11 under case number 22-10320.
