Red River Waste gets shorter-than-requested exclusivity extension

Olympia, Wash., Feb. 14 – Red River Waste Solutions, LP received a shorter-than-requested extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to an order filed Monday with the U.S. Bankruptcy Court for the Northern District of Texas.

The court extended the plan filing period through March 13 from Feb. 11 and the solicitation period through May 13 from April 12. As previously reported, the company had asked the court for a longer extension, with the plan filing period being extended through June 13 and the solicitation period through Aug. 10.

The exclusivity extension motion drew an objection on last week from the official committee of unsecured creditors. The group said that while it believes a four-month extension is too long, it would support a shorter 30-day extension if the committee was granted co-exclusive rights regarding filing and soliciting votes on a plan.

Despite the committee’s request for co-exclusivity, Monday’s order said that only Red River is authorized to file and solicit votes on a plan during the extended period.

The Dripping Springs, Tex.-based waste management company filed bankruptcy on Oct. 14 under Chapter 11 case number 21-42423.
