Johnson & Johnson talc victim attorneys seek new trials, negotiations

Olympia, Wash., Aug. 11 – The dismissal of Johnson & Johnson subsidiary LTL Management LLC’s second Chapter 11 bankruptcy case should lead courts to resume scheduling civil trials across the nation, attorneys with the Beasley Allen Law Firm said in a press release issued Friday afternoon.

“The women and their families who have been devastated by ovarian cancer have waited for more than two years as J&J sought bankruptcy protections in an effort to delay or deny accountability in the tort system,” said Leigh O'Dell, co-chair of the talc plaintiffs steering committee in the multidistrict litigation in New Jersey federal court.

“Tragically, hundreds of women have died during this delay and will never see their day in court. Now our firm can aggressively begin seeking a resumption of the trials that have been on hold for far too long.

“We're certain that other firms will do the same.”

As previously reported, the company had its second Chapter 11 case thrown out by the U.S. Bankruptcy Court for the District of New Jersey on July 28.

A total of 10 motions and two joinders were filed seeking dismissal of the case, arguing that, like the first case, the second was filed in bad faith. Among the movants were the official committee of talc claimants, an informal group of mesothelioma claimants, various talc claimants, an informal committee of states holding consumer protection claims, and the U.S. trustee overseeing the case.

Johnson & Johnson is a consumer products company based in New Brunswick, N.J. The LTL Management subsidiary filed its initial Chapter 11 bankruptcy petition on Oct. 14, 2021 under case number 21-30589. The new case was filed on April 4 under case number 23-12825.
