Diocese of Norwich disclosure statement continued as status conference

Olympia, Wash., Aug. 29 – Norwich Roman Catholic Diocesan Corp., known as the Roman Catholic Diocese of Norwich, had the hearing on approval of the disclosure statement for its Chapter 11 plan continued from Aug. 29 as a status conference to be held on Sept. 13, according to a minute entry filed Tuesday with the U.S. Bankruptcy Court for the District of Connecticut.

The plan is being proposed by the diocese and the official committee of unsecured creditors, as previously reported.

On Thursday, Region 2 U.S. trustee William K. Harrington objected to the disclosure statement, which had been amended and refiled Friday evening.

Harrington said the size of the documents and the timing of the filing has left parties with an extremely limited window of less than one business day to review the modifications and meet the existing objection deadline, which was Monday.

The U.S. trustee said the initial plan and disclosure statement were missing information, and while some of that information was given in the amended documents, there still is not enough for creditors to make an informed decision about the plan.

Harrington also said some components of the amended plan make it unconfirmable, which requires disapproval of the amended disclosure statement.

The U.S. trustee has concerns about the proposed non-debtor releases, exculpation provisions, indemnification provisions and the channeling injunction under the plan.

In the objection, Harrington had asked the court to move the disclosure statement hearing to a later date.

The Norwich, Conn.-based diocese filed bankruptcy on July 15, 2021 under Chapter 11 case number 21-20687.
