Tillary Hotel trustee asks court to order return of funds to estate

Chicago, Dec. 19 – 85 Flatbush RHO Mezz LLC, the owner of the Tillary Hotel in Brooklyn, has more funds due into the estate, according to the trustee in the case and a filing with the U.S. Bankruptcy Court for the Southern District of New York.

The trustee is asking the defendants to return certain funds as property to the the estate and is asking the court to direct the defendants to do so immediately, with an award of pre-judgment interest.

Specifically, trustee Stephen S. Gray is asking Toby Moskovits and Michael Lichtenstein to return $2,305,503.80 in Employee Retention Credit refunds, $1,540,687.10 in IRS refunds and $764,816.70 of as-yet unpaid refunds.

The owner of the boutique hotel in Brooklyn, N.Y., filed bankruptcy on Dec. 18, 2020 under Chapter 11 case number 20-23280.
