Former NS8 requests 90-day extension of exclusive plan periods

Olympia, Wash., Feb. 2 – Cyber Litigation Inc., formerly NS8, Inc., is seeking a 90-day extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to a motion filed Monday with the U.S. Bankruptcy Court for the District of Delaware.
Specifically, the company asked the court to extend the plan filing period through May 25 and the solicitation period through July 26.
“This Chapter 11 case presents various complex and time-consuming issues, including a robust investigation into possible estate causes of action, coordinating and assisting governmental authorities with ongoing investigations into Rogas’ pre-petition activities, marketing and effectuating sales of substantially all of the debtor’s assets to third parties, among other matters,” the company said.
“These issues have required undivided attention and effort by the debtor and its professionals since the petition date.”
The company said that in light of the complexity of the case and the significant progress made so far, the extensions are necessary for the negotiation, filing, solicitation and confirmation of a Chapter 11 plan.
A hearing is scheduled for Feb. 16.
NS8 is a cyberfraud-prevention company based in Las Vegas. The company filed Chapter 11 bankruptcy on Oct. 27 under case number 20-12702.
