Lucky’s Market seeks further extension of exclusive plan periods

By Sarah Lizee

Olympia, Wash., Nov. 30 – Lucky’s Market is seeking a seventh extension of its exclusive periods for filing and soliciting votes on a Chapter 11 plan, according to a motion filed Monday with the U.S. Bankruptcy Court for the District of Delaware.

Specifically, Lucky’s is asking the court to extend the exclusive plan filing period through March 1 from Nov. 30 and the solicitation period through April 28 from Jan. 28.

As previously reported, the company filed a Chapter 11 joint plan of liquidation and related disclosure statement on Oct. 29. The disclosure statement was approved on Nov. 24, and the confirmation hearing is scheduled for Dec. 23.

The company said it has been working with its secured lender and the official committee of unsecured creditors to achieve its goal of confirming the plan.

Lucky’s is a Niwot, Colo.-based supermarket operator. The company filed bankruptcy on Jan. 27, 2020 under Chapter 11 case number 20-10166.
