Aldrich Pump: Mesothelioma claimant group moves to dismiss case

Olympia, Wash., April 14 – Aldrich Pump LLC and Murray Boiler LLC are facing a call for dismissal of their Chapter 11 bankruptcy cases from law firm Maune Raichle Hartley French & Mudd, LLC on behalf of a group of 47 mesothelioma claimants, according to a motion filed with the U.S. Bankruptcy Court for the Western District of North Carolina.

The firm said the debtors are not and have never been financially distressed by asbestos liabilities.

“Aldrich and Murray are not in need of resuscitation; they have no need for a fresh start,” the firm said in the motion.

“To the contrary, without any restructuring of their liabilities or assets, and without altering their current business practices, they are fully capable of paying their current and future asbestos liabilities as they come due.

“The debtors’ petition is, therefore, both objectively futile and lacking in good faith.”

A joinder to the dismissal motion was filed Thursday by Motley Rice LLC on behalf of its clients.

A hearing is scheduled for April 27.

Davidson, N.C.-based Aldrich provides climate control solutions. The company filed bankruptcy on June 17, 2020 under Chapter 11 case number 20-30608.
