Rubie’s Costume asks for 45-day extension of exclusive plan periods

Olympia, Wash., Nov. 5 – Rubie’s Costume Co., Inc. is seeking a 45-day extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to a motion filed Thursday in the U.S. Bankruptcy Court for the Eastern District of New York.

Specifically, the company is asking the court to extend the plan filing period through Dec. 31 and the solicitation period through Feb. 28.

The debtors said they have been working in cooperation with the official committee of unsecured creditors on the terms of a plan of liquidation.

“The expiration of the exclusive filing period would permit any party in interest to file a plan, which would result in wasteful and expensive litigation that would diminish the estates’ resources and, ultimately, harm the creditors by reducing the funds available for distribution,” the debtors said in their motion.

Melville, N.Y.-based Rubie’s designs, manufactures and distributes Halloween costumes and accessories. The company filed bankruptcy on April 30 under Chapter 11 case number 20-71970.
