J&J talc unit’s request for claims estimation granted by court

Olympia, Wash., July 28 – Johnson & Johnson subsidiary LTL Management LLC’s request for an order that allows the total value of talc claims asserted against the company to be estimated was granted, according to court documents filed with the U.S. Bankruptcy Court for the District of New Jersey.

As previously reported, the company said this would facilitate its ongoing mediation with the committee, which is designed to achieve an equitable resolution of the Chapter 11 case. LTL said the mediation hasn’t led to a resolution yet.

“[Estimation] will require the parties to focus on and develop well-supported, well-reasoned positions with respect to the central issue in this case, and it will provide a framework for further mediation sessions that will significantly enhance the prospects for successful negotiation of a consensual plan,” LTL said in a status report filed Friday.

LTL breaks out the estimation process into two phases. Phase one would address the medical evidence relevant to the ovarian cancer and mesothelioma claims, and the next phase would address the value of the claims.

One additional mediation session would be scheduled after the court’s estimation ruling. The mediators would be free to schedule further mediation sessions during the estimation process.

Johnson & Johnson is a consumer products company based in New Brunswick, N.J. The LTL Management subsidiary filed Chapter 11 bankruptcy on Oct. 14, 2021 under case number 21-30589.
