Marsh Supermarkets seeks exclusivity extension ahead of plan hearing

Pittsburgh, May 8 – Marsh Supermarkets Holding, LLC requested a 120-day extension of its exclusive periods for filing and soliciting votes on a Chapter 11 plan, according to a motion filed Tuesday with the U.S. Bankruptcy Court for the District of Delaware.

The company is asking the court to extend its exclusive filing period through Sept. 5 from May 8 and the solicitation period through Nov. 2 from July 5.

Now that its sale transactions have closed and store-closing sales have been completed and the related store leases have all been rejected, Marsh said it is winding down its operations.

As previously reported, the company filed a plan of liquidation on March 22. The plan confirmation hearing is scheduled for June 11.

“Termination of the exclusive periods in these Chapter 11 cases would adversely impact the debtors’ wind-down efforts and their progress in administering these Chapter 11 cases,” the motion said.

A hearing is scheduled for June 11.

Marsh, an Indianapolis-based grocery chain, filed bankruptcy on May 11, 2017. The Chapter 11 case number is 17-11066.
