Marsh Supermarkets eyes exclusivity extension to prep adequate plan

Pittsburgh, Sept. 7 – Marsh Supermarkets Holding, LLC requested an extension of its exclusive periods for filing and soliciting votes on a Chapter 11 plan, according to a motion filed Thursday with the U.S. Bankruptcy Court for the District of Delaware.

The company is asking the court to extend its exclusive filing period through Jan. 8 from Sept. 8 and the solicitation period through March 7 from Nov. 7.

Now that its sale transactions have closed and its core store-closing sales have been completed and the related store leases have all been rejected, Marsh said it is winding down its operations and affairs and its Chapter 11 cases.

“The debtors submit that the requested extensions are both appropriate and necessary to afford the debtors with sufficient time to adequately prepare a viable Chapter 11 plan and related disclosure statement,” the motion said.

A hearing is scheduled for Oct. 26.

Marsh, an Indianapolis-based grocery chain, filed bankruptcy on May 11. The Chapter 11 case number is 17-11066.
