Univita trustee seeks approval of $140,000 Prestige Health settlement

Pittsburgh, Aug. 6 – Univita Holdings LLC’s Chapter 7 trustee, David W. Carickhoff, requested court approval of a settlement reached with Florida True Health Inc., which does business as Prestige Health Choice, according to a motion filed Friday with the U.S. Bankruptcy Court for the District of Delaware.

The trustee said Prestige and Univita debtors Univita Homecare Solutions, LLC and Univita of Florida, Inc. are parties to various service agreements.

The trustee claims Prestige owes $1.37 million for services provided under the agreements. Carickhoff said Prestige claims it does not owe the alleged outstanding amount and filed a $1.2 million secured setoff claim in Univita’s bankruptcy case.

Under the proposed settlement, Prestige will pay $140,000 to the trustee and Prestige’s claim will be disallowed.

A hearing is scheduled for Sept. 5.

Univita is a Miramar, Fla.-based home-care products provider that filed for bankruptcy on Aug. 28, 2015. The Chapter 7 case number is 15-11786.
