USA Discounters asks court for extension of exclusivity periods

Bethlehem, Pa., Nov. 13 – USA Discounters Ltd. sought court approval to extend its exclusive periods for filing a Chapter 11 plan of reorganization and soliciting votes on the plan, according to a motion filed Friday with the U.S. Bankruptcy Court for the District of Delaware.

The company is requesting an extension of its exclusive filing period through March 21 and an extension of its solicitation period through May 20, 2016.

USA Discounters said it is actively working on developing a Chapter 11 plan and disclosure statement.

“Given these and other numerous demands on the debtors’ limited time and resources, the debtors submit that the complexity and relatively short duration of these cases warrant the extension of the exclusive periods,” the motion said.

The company also said termination of the exclusivity periods could potentially impede progress made to date and adversely impact efforts to preserve and maximize the value of the estates.

A hearing on the extension request is scheduled for Dec. 7.

USA Discounters, a Norfolk, Va.-based retailer, filed for bankruptcy on Aug. 25. The Chapter 11 case number is 15-11755.
