Old FOH requests extension of exclusivity periods by four months

By Mark Reccek

Bethlehem, Pa., Aug. 17 – Old FOH, Inc., formerly Frederick's of Hollywood, Inc., requested court approval to extend its exclusive periods for filing a Chapter 11 plan of reorganization and soliciting votes on the plan, according to a motion filed Friday with the U.S. Bankruptcy Court for the District of Delaware.

The company is requesting an extension on its exclusive filing period through Dec. 15 from Aug. 17 and an extension of the solicitation period through Feb. 15, 2016 from Oct. 16.

According to the motion, the company is requesting an extension to allow for negotiating, finalizing, filing and obtaining confirmation of a Chapter 11 plan.

“Maintaining the exclusive right to file and solicit votes on a Chapter 11 plan of liquidation is critical to the debtors’ ability to complete these necessary steps as efficiently and expeditiously as possible,” the motion said.

A hearing on the matter is scheduled for Sept. 15.

Old FOH is a Los Angeles-based retailer of women’s intimate apparel and related products that filed for bankruptcy on April 19. The Chapter 11 case number is 15-10836.
