MacKeyser asks court for three-month extension of exclusive periods

New York, Oct. 14 – MacKeyser Holdings, LLC is seeking a 90-day extension of its exclusive Chapter 11 plan filing and solicitation periods, according to an Oct. 13 motion with the U.S. Bankruptcy Court for the District of Delaware.

The company asked that its exclusive filing period be extended through Jan. 16 from Oct. 18 and its solicitation period through March 17 from Dec. 17.

According to the motion, MacKeyser said it has spent the past several months transitioning to bankruptcy, conducting assets sales, transitioning its assets to buyers and negotiating a global settlement with its official committee of unsecured creditors and debtor-in-possession lenders.

The requested extension will allow the company adequate time to file a consensual plan, which is required to become effective by March 31 under the approved settlement.

MacKeyser has already begun developing a disclosure statement based on a liquidating plan and liquidating trust agreement, according to the motion.

A hearing is scheduled for Nov. 3.

Las Vegas-based MacKeyser Holdings and operating affiliates American Optical Services, LLC and Exela Hearing Services, LLC manage integrated eye care and hearing systems providers. The company filed for bankruptcy on June 20 under Chapter 11 case number 14-11550.
