U.S. Energy Biogas seeks one-month extension to exclusive plan filing period

By Caroline Salls

Pittsburgh, March 29 - U.S. Energy Biogas Corp. requested an extension to its exclusive period to file a plan of reorganization, according to a Wednesday filing with the U.S. Bankruptcy Court for the Southern District of New York.

The company wants to extend its exclusive plan filing period to April 30 from March 29.

According to the motion, because of the substantial time, attention and effort of litigation, reporting requirements, handling operational issues, negotiating the resolution of claims and negotiating the terms and structure of an exit facility have required of the company's management, U.S. Energy Biogas has not had the time or resources necessary to finalize the terms of the plan of reorganization.

A hearing is scheduled for April 17.

U.S. Energy Biogas, an Avon, Conn.-based renewable energy business, filed for bankruptcy on Nov. 30. Its Chapter 11 case number is 06-12827.
