UAL retired pilots ask court to order recount of plan vote

Pittsburgh, Jan. 10 - UAL Corp.'s Retired Pilots Benefit Protection Association asked the bankruptcy court to order the company to retabulate the plan of reorganization votes in the other unsecured claims class and to count the votes of retired pilots that were improperly disqualified.
The association also requested the court order UAL to publish an amendment to the voting report submitted by Poorman-Douglas Corp. before the plan confirmation hearing scheduled for Jan. 18.
According to a Tuesday filing with the U.S. Bankruptcy Court for the Northern District of Illinois, the company failed to count the votes of more than 1,500 retired pilots.
"United has challenged the ballots reflecting the votes of retired pilots apparently because the retired pilots sought claim amounts for the value of lost non-qualified pension benefits greater than the amounts United had reflected on the ballots," the association said in the motion.
The association contended that, regardless of any dispute, the company should have at least counted the claim amount votes at the amounts United listed on the ballots from its books and records, rather than not count any amount at all.
A hearing on retabulating the votes is scheduled for Thursday.
UAL, the Chicago-based parent of United Airlines, filed for bankruptcy on Dec. 9, 2002. Its Chapter 11 case number is 02-48191.
