Uni-Marts withdraws DIP financing motion

Pittsburgh, Jan. 14 - Uni-Marts LLC has withdrawn its motion for approval of $3.5 million in debtor-in-possession financing from SB Capital Group, LLC, according to a Wednesday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company requested court approval of the DIP financing on June 6, 2008, but the financing was never approved. The hearing was postponed several times, most recently to Jan. 20.

Uni-Marts, a State College, Pa.-based convenience store operator, filed for bankruptcy on May 29, 2008. Its Chapter 11 case number is 08-11037.
