Tom's Foods requests extension to exclusive periods to file plan, solicit votes

Pittsburgh, June 30 - Tom's Foods Inc. requested an extension to its exclusive periods to file a plan of reorganization and solicit votes on the plan, according to a Thursday filing with the U.S. Bankruptcy Court for the Middle District of Georgia.

The company wants to extend the exclusive period to file a plan to Oct. 3 from Aug. 4 and to solicit votes to Dec. 2 from Oct. 3.

Tom's Foods said the exclusivity extensions are necessary because of the size and complexity of the case.

Also, the company said it has spent "considerable time" working through reclamation and other claims, requests for assurance of payment from utilities, cash management procedures and retention of professionals.

Tom's, a Columbus, Ga.-based snack food company, filed for bankruptcy on April 6. Its Chapter 11 case number is 05-40683.
