Steve & Barry's seeks four-month exclusivity extension

Portland, Ore., Oct. 3 - Steve & Barry's requested a four-month extension to its exclusive periods to file a plan of reorganization and solicit votes on the plan, according to a Tuesday filing with the U.S. Bankruptcy Court for the Southern District of New York.

The company wants to extend the exclusive plan-filing period to March 6 from Nov. 6 and the solicitation period to May 5, 2009 from Jan. 5.

Steve & Barry's said that although it has closed on the $163 million sale of substantially all of its assets, the company still has a number of tasks that need to be performed in connection with the sale.

A hearing has been scheduled for Oct. 16.

Steve & Barry's, a Port Washington, N.Y.-based national apparel and accessories retailer, filed for bankruptcy on July 9 in the U.S. Bankruptcy Court for the Southern District of New York. Its Chapter 11 case number is 08-12579.
