Asarco $13.5 million Hayden smelter site clean-up settlement approved

Pittsburgh, May 27 - Asarco LLC received court approval of a settlement under which the company has agreed to complete up to $13.5 million in environmental clean-up work related to its Hayden, Ariz., smelter site, according to a Tuesday filing with the U.S. Bankruptcy Court for the Southern District of Texas.

According to the motion, the work will be done at residential portions of the Hayden site where levels of arsenic, lead or copper exceed specified levels.

Asarco said it will also address hazardous substance sources and releases on parts of the Hayden site that are not otherwise covered under federal or state environmental programs.

The company will not need to spend the full $13.5 million if the Environmental Protection Agency deems that the work is completed sooner.

Asarco, a Tucson, Ariz., mining company, filed for bankruptcy on Aug. 9, 2005. Its Chapter 11 case number is 05-21207.
