Owens Corning claimants request class certification linked to roof tile litigation settlement

Pittsburgh, June 14 - Owens Corning claimants John and Kathleen Stratton, Robert and Linda Lopez and Anne Rudin requested certification of a settlement class in connection with litigation over roof tiles sold by Owens Corning, according to a Wednesday filing with the U.S. Bankruptcy Court for the District of Delaware.
According to the motion, the settlement calls for creation of an $11 million settlement fund against which class members can make their claims based on a plan of distribution.
The claimants represent a class of residential and commercial property owners who allege that MiraVista tiles had an undue tendency to lift, warp and curl, break off and slide out of place, crack, leak, and discolor, resulting in weather damage to roofing paper, fasteners, flashing, underlayment, and wood substrate and structural members.
The settlement requires certification of a settlement class, according to the filing.
A hearing is scheduled for July 24.
Owens Corning, a Toledo, Ohio, building materials company, filed for bankruptcy on Oct. 5, 2000. Its Chapter 11 case number is 00-3837.
