Owens Corning objects to several asbestos damage claims

Houston, Jan. 24 - Owens Corning objected to 20 asbestos property damage claims filed by various companies and organizations, according to a court filing Jan. 21.

Owens Corning said, for example, in the St. John Bosco School and the St. John Evangelist School cases that it is requesting that the officials of the school provide further information in discovery.

They believe the claims are "objectionable under state law" because they do not prove that Owens Corning asbestos-containing products are installed in the buildings, because the claims do not prove damage and because they fail to prove causation.

Objections to 42 property claims were scheduled to be heard at a Jan. 24 hearing, which will also consider a proposed case management order.

Owens Corning filed objections to the 42 property claims on Dec. 3, 2004, saying it believed it could resolve the claims without being involved in a plan.

The company said that the debtors filed a proposed case management plan in September 2004 that was considered by the court on Oct. 25. The hearing resulted in objections from some claimants. Some said Owens Corning should file its objections before the court considers the plan. The court agreed and said that after the objections were filed, then it would issue a plan that requires responses from both the claimants and discovery.

Owens Corning, a Toledo, Ohio-based building materials company, filed for bankruptcy on Oct. 5, 2000 in the U.S. Bankruptcy Court for the District of Delaware. Its Chapter 11 case number is 00-3837.
