Orius seeks two-week exclusivity extension to finalize plan terms

Pittsburgh, Sept. 12 - Orius Corp. requested a 14-day extension to its exclusive periods to file a plan of liquidation and solicit votes on the plan, according to a Tuesday filing with the U.S. Bankruptcy Court for the Northern District of Illinois.

The company wants to extend its exclusive plan-filing period to Sept. 28 from Sept. 14 and the solicitation period to Nov. 29 from Nov. 15.

According to the motion, the company has an agreement in principle on the plan with its secured lenders and official committee of unsecured creditors, and the brief extension will give the parties time to agree on all the terms and conditions of the plan.

A hearing is scheduled for Thursday.

Orius, a West Palm Beach, Fla., provider of construction, deployment and maintenance services to the telecommunications, broadband, gas and electric utilities and government industries, filed for bankruptcy on Dec. 12, 2005. Its Chapter 11 case number is 05-63876.
