Opus South eyes exclusivity extension to wait out affiliate cases

Charlotte, N.C., March 15 - Opus South Corp. requested a 120-day extension to its exclusive periods to file a plan of reorganization and solicit votes on the plan, according to a Friday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company wants to extend its exclusive filing period to July 16 from March 18 and the solicitation period to Sept. 14 from May 16.

According to the motion, Opus South wants to keep its exit options open, including the right to file a Chapter 11 plan, until all of the affiliated debtors for which it provides management services have finalized their bankruptcy cases.

A hearing is scheduled for March 30.

Previously the court extended the company's exclusive plan-filing period to March 18 from Dec. 18, and the solicitation period to May 16 from Feb. 16.

Opus, an Atlanta-based design-build development firm, filed for bankruptcy on April 22, 2009. Its Chapter 11 case number is 09-11390.
