Former Fresh & Easy eyes 60-day exclusivity extension to settle claims

New York, March 14 - Old FENM Inc., formerly Fresh & Easy Neighborhood Market Inc., has requested a second extension of its exclusive plan of reorganization filing and solicitation periods, according to a Thursday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company would like to extend its filing period through May 30 from April 1 and its solicitation period through July 29 from May 30.

The company is seeking the extension to allow its government bar date to pass and to resolve the employee claims filed against it, according to the filing, which will allow it to propose a fully consensual Chapter 11 plan.

A hearing is scheduled for April 1.

Fresh & Easy, a Wilmington, Del.-based grocery store chain, filed for bankruptcy on Oct. 1. The Chapter 11 case number is 13-12569.
