Judge in Oglebay Norton case denies request for official toxic tort claimants committee

Washington, Aug. 25 - The judge overseeing Oglebay Norton Co.'s bankruptcy case denied a request for an official toxic tort claimants committee, according to an order filed Tuesday with the U.S. Bankruptcy Court for the District of Delaware.

In his order, judge Joel Rosenthal did not explain why he denied the decision.

The law firms that requested the committee are Cooney & Conway, Kelly & Ferraro LLP, Maritime Asbestos Legal Clinic, Bevan Associates LPA, Baron & Budd PC and Silber Pearlman LLP.

The law firms alleged the more than 100,000 toxic tort claimants' interests have not been well served and need an official committee to protect the claimants' interests.

A previous request for an official committee was also rejected.

Oglebay Norton, a Cleveland-based minerals company, filed for bankruptcy on Feb. 23. Its Chapter 11 case number is 04-10558.
