Mirant gets William Snyder as examiner

By Jeff Pines

Washington, April 14 - Mirant Corp. learned William Snyder's appointment as trustee was approved under an order from the U.S. Bankruptcy Court for the Northern District of Texas, Fort Worth Division, filed Wednesday.

Details on Snyder's qualifications were not immediately available from the Office of the U.S. Trustee, Region 6, which includes the Fort Worth Division.

The court ordered the appointment of an examiner on April 5.

The official committee of unsecured creditors filed a request seeking the authority to examine the Southern Co., which spun off Mirant because it was conducting its own investigation.

Mirant objected and, according to the filing, the court ordered everyone to work out a coordinated method of investigating whether there were any valid claims against Mirant's former parent, Southern Co., which spun off Mirant in 2001. Both are Atlanta-based companies.

If they were unable to reach a consensus on how to proceed, the court would appoint an examiner. They did not, and the judge did.

The official committee of unsecured creditors of Mirant Americas Generation LLC is on the record opposing the appointment of an examiner.

Mirant filed for bankruptcy on July 14. Its Chapter 11 case number is 03-46590.
