Midway Games requests fifth exclusivity extension to prepare plan

Charlotte, N.C., Dec. 24 - Midway Games, Inc. requested a fifth extension to its exclusive periods to file a plan of reorganization and solicit votes on the plan, according to a Monday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company wants to extend its exclusive plan-filing period to Jan. 25 from Dec. 29 and the solicitation period to March 30 from Feb. 28.

A hearing has been scheduled for Jan. 26.

The company has "worked expeditiously to address critical issues" and move its cases forward in a relatively short period of time, the filing said.

Midway Games, based in Chicago, is a developer and publisher of interactive entertainment software for videogame systems and personal computers. The company filed for bankruptcy on Feb. 12, 2009, and its Chapter 11 case number is 09-10465.
