Majestic Star gets more time to file plan; committee objection denied

By Lisa Kerner

Charlotte, N.C., Nov. 30 - Majestic Star Casino, LLC was granted an extension of its exclusive periods to file and solicit votes on a plan of reorganization, according to a Tuesday filing with the U.S. Bankruptcy Court for the District of Delaware.

The court extended Majestic Star's exclusive filing period to Jan. 15 from Sept. 17 and the solicitation period to March 15 from Nov. 17.

As previously reported, the company said the extension would allow it to continue dialogue with any creditors whose objections are not yet resolved without "having to overcome the massive distraction that would be posed by fights over competing plans."

Majestic Star's official committee of unsecured creditors had filed an objection to the request so that it could file and seek authority to solicit a committee-sponsored plan of reorganization.

The court deemed the objection withdrawn.

Majestic Star, a Las Vegas-based owner and operator of casino hotels, filed for bankruptcy on Nov. 23, 2009. Its Chapter 11 case number is 09-14136.
