Diomed prevails in sheath patent litigation, AngioDynamics' claims denied

By Lisa Kerner

Charlotte, N.C., Sept. 11 - The U.S. District Court of Delaware granted Diomed Holdings, Inc.'s motion to dismiss and denied AngioDynamics' motion to amend its complaint seeking to declare the claims of Diomed's two marked sheath patents invalid, non-infringed and unenforceable.

The litigation surrounds Diomed's U.S. Patent Numbers 6,981,971 and 6,986,766 related to an introducer sheath/optical fiber arrangement for use in the endovascular laser treatment of varicose veins.

Diomed, based in Andover, Mass., develops minimal and micro-invasive medical procedures using its proprietary laser technologies and disposable products.
