Liberty Medical Supply second exclusivity extension approved by court

New York, March 12 - Liberty Medical Supply, Inc.'s second request for an extension of its exclusive plan of reorganization filing and acceptance periods was approved, according to a Wednesday order with the U.S. Bankruptcy Court for the District of Delaware.

The company's filing period is extended through June 30 from March 14 and its solicitation period through Sept. 2 from May 14.

As previously reported, the company sought the extension because of the complexity of issues it is facing during the reorganization process.

Among those issues are ongoing discussions with Centers for Medicare and Medicaid Services regarding its post-pay audit claim and a disagreement with Medco over responsibility for sales and use taxes incurred before its buy-out agreement.

Liberty Medical, a Port St. Lucie, Fla.-based health-care products home delivery provider, filed for bankruptcy on Feb. 15, 2013. The Chapter 11 case number is 13-10262.
