Liberty Medical seeks second extension for exclusivity periods

New York, Feb. 21 - Liberty Medical Supply, Inc. requested a second extension of its exclusive plan of reorganization filing and acceptance periods, according to a Thursday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company wants to extend its filing period through June 30 from March 14 and its solicitation period through Sept. 2, 2014 from May 14.

The company is requesting the additional time due to the "complex nature of the myriad issues" it is facing during the reorganization process, the filing stated.

Among the issues are ongoing discussions with Centers for Medicare and Medicaid Services regarding its post-pay audit claim and a disagreement with Medco over responsibility for sales and use taxes incurred prior its buy-out agreement.

A hearing is scheduled for March 13.

Liberty Medical, a Port St. Lucie, Fla.-based health-care products home delivery provider, filed for bankruptcy on Feb. 15, 2013. The Chapter 11 case number is 13-10262.
