Former Liberty Medical seeks four-month extension of plan exclusivity

By Jim Witters

Wilmington, Del., Oct. 3 - ATLS Acquisition, LLC, formerly Liberty Medical Supply, Inc., is seeking a four-month extension of its exclusive periods for filing a Chapter 11 plan and for soliciting plan acceptances, according to an Oct. 3 filing with the U.S. Bankruptcy Court for the District of Delaware.

The company says it needs the additional time to continue working on "the myriad issues impacting the debtors' reorganization efforts."

If the request is approved, the exclusive period for filing a Chapter 11 plan would be extended through Feb. 21 from Oct. 24. The exclusive period for soliciting votes would be extended through April 23 from Dec. 24.

A hearing on the extension request is scheduled for 9:30 a.m. ET on Oct. 23.

Liberty Medical, a Port St. Lucie, Fla.-based health-care products home delivery provider, filed for bankruptcy on Feb. 15. The Chapter 11 case number is 13-10262.
