Interstate Bakeries hearing on reconstitution of board continued to Jan. 5

Portland, Ore., Dec. 21 - The hearing on Interstate Bakeries Corp.'s motion that the U.S. Bankruptcy Court for the Western District of Missouri constitute its board of directors with the nine current directors will be continued on Jan. 5, according to a Thursday filing with the court.

The continued hearing will also address the company's request to keep shareholder Brencourt Advisors LLC from prosecuting an action in the Delaware Court of Chancery that would force a shareholders meeting to reconstitute the board, as well as the official committee of unsecured creditors' motion that the court reconstitute the board with seven members.

The hearing began Thursday.

Interstate, a Kansas City, Mo., bakery operator, filed for bankruptcy on Sept. 22, 2004. Its Chapter 11 case number is 04-45814.
