Fitch: Uncertainty in China, Indonesia

Fitch Ratings commented that the insolvency regimes of China and Indonesia leave creditors exposed to significant uncertainties, notwithstanding reforms to the regimes that have been implemented relatively recently.

In a new report, the agency said that China's insolvency regime is characterized by relatively new and untested laws, while that of Indonesia reflects a track record of inconsistent application of legal principles and time-consuming legal processes.

The agency noted that these factors give rise to uncertainties surrounding the recovery outcomes and timeframes for creditors in insolvency proceedings, especially for offshore creditors.
