HomeBanc seeks fourth extension of exclusive plan vote solicitation period
By Caroline Salls
Pittsburgh, Sept. 17 - HomeBanc Mortgage Corp. requested a fourth extension to its exclusive period to solicit votes on its plan of liquidation, according to a Tuesday filing with the U.S. Bankruptcy Court for the District of Delaware.
Specifically, the company wants to extend its exclusive solicitation period to Jan. 5 from Oct. 6.
According to the motion, the hearing on approval of the company's disclosure statement has been postponed while HomeBanc works to resolve issues that could affect creditor distributions.
The company said the extension is necessary because it cannot begin to solicit votes on its liquidation plan until the disclosure statement is approved.
A hearing on approval of the exclusivity extension is scheduled for Oct. 7.
HomeBanc, an Atlanta-based mortgage banking business, filed for bankruptcy on Aug. 9, 2007. Its Chapter 11 case number is 07-11079.
