Hawkeye Renewables seeks two-month extension of exclusive periods

Charlotte, N.C., April 20 - Hawkeye Renewables, LLC requested an extension to its exclusive periods to file a plan of reorganization and to solicit votes on the plan, according to a Monday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company wants to extend the exclusive plan-filing period to June 19 from April 20 and the solicitation period to Aug. 18 from June 19.

A hearing has been scheduled for May 11.

According to Hawkeye, the extension will allow the company to "head off the delays associated with the filing and prosecution of competing plans."

Hearings to approve the company's disclosure statement and pre-packaged plan were held on March 18, March 19 and April 12. Parties of interest have until April 30 to submit post-trial briefs and proposed findings of fact and conclusions of law, the filing said.

Hawkeye Renewables is an Iowa Falls, Iowa, manufacturer of alcohol-based fuel derived from corn. It filed for bankruptcy on Dec. 21 and its Chapter 11 case number is 09-14461.
