Goody's granted second exclusivity extension to evaluate claims

New York, Sept. 3 - Goody's, LLC received a shorter-than-expected second extension to its exclusive periods to file a plan of reorganization and solicit votes on the plan, according to a Thursday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company's exclusive filing period was extended to Sept. 25 from Aug. 11 and the solicitation period to Nov. 26 from Sept. 25. Goody's had requested a plan-filing extension to Oct. 12.

As previously reported, Goody's said in its motion that although it has made substantial progress in negotiating the terms of a plan, more time is needed to evaluate claims and finalize the plan.

In June the company was granted a three-month exclusivity extension.

Goody's, a Knoxville, Tenn., family apparel retailer, filed for bankruptcy on Jan. 13, 2009. Its Chapter 11 case number is 09-10124.
