Enzo Biochem to pursue patent claims

By Elaine Rigoli

Tampa, Fla., July 19 - Enzo Biochem Inc. reported that a federal court in New York issued a ruling relating to the claim terms in eight patents asserted against defendants Affymetrix, Roche, Amersham, PerkinElmer, Sigma Aldrich, Orchid Biosciences and Molecular Probes.

The cases are before judge John Sprizzo in the U.S. District Court for the Southern District of New York.

Enzo said the ruling supports the company's position that hundreds of defendants' products infringe certain Enzo patents.

The ruling means Enzo may pursue its patent infringement claims and pursue claims that defendants breached their contractual obligations to Enzo.

Enzo, located in Farmingdale, N.Y., is engaged in the research, development and manufacture of health care products.
