Delphi autoworkers' union asks court to exclude non-bargaining agreement parties from rejection hearing

Pittsburgh, April 27 - Delphi Corp.'s autoworkers' union asked the court to exclude Wilmington Trust Co., Appaloosa Management LP, Wexford Capital LLC and the official committee of unsecured creditors from participation in the hearing on rejection of the autoworkers' collective bargaining agreement, according to a Thursday filing with the U.S. Bankruptcy Court for the Southern District of New York.

The union said only parities to the collective bargaining agreement should be allowed to participate in the hearing.

According to the motion, Delphi, the UAW and five other unions will already be involved in the hearing, and the proceedings will become "unmanageable" if even more parties are allowed to participate.

A hearing is scheduled for May 9.

Delphi, a Troy, Mich.-based automotive electronics manufacturer, filed for bankruptcy on Oct. 8, 2005. Its Chapter 11 case number is 05-44481.
