Delphi, GM agree to allow Delphi creditors committee access to GM labor, spin-off and claims information

By Caroline Salls

Pittsburgh, April 12 - Delphi Corp. and General Motors Corp. reached an agreement under which Delphi's official committee of unsecured creditors can obtain access to some GM documents related to its labor and pension obligations, the 1999 spin-off of Delphi from GM, the ongoing relationship between GM and Delphi and claims and potential claims asserted by GM against Delphi.

According to a Tuesday filing with the U.S. Bankruptcy Court for the Southern District of New York, on March 24, Delphi's official committee of unsecured creditors asked the court to force GM to produce these documents following unsuccessful requests to obtain the information.

According to Tuesday's court filing, Delphi and GM negotiated the agreement to avoid potential litigation.

Delphi, a Troy, Mich.-based automotive electronics manufacturer, filed for bankruptcy on Oct. 8. Its Chapter 11 case number is 05-44481.
