Affirmative Insurance Chapter 11 case converted to Chapter 7

New York, March 10 – Affirmative Insurance Holdings, Inc.’s Chapter 11 bankruptcy case was converted to a Chapter 7 case, according to an order issued Thursday by the U.S. Bankruptcy Court for the District of Delaware.
Also on Thursday, the court denied rehabilitator Anne Melissa Dowling’s motion to dismiss Affirmative’s Chapter 11 case. Earlier this month, Dowling asked the court to dismiss the case on the grounds that the debtor has no assets to reorganize or liquidate.
Affirmative filed its plan of liquidation with the court on Tuesday, and a hearing on the plan is scheduled for May 20.
Based in Burr Ridge, Ill., Affirmative is a producer and provider of personal non-standard automobile insurance policies for individual consumers. The company filed for bankruptcy on Oct. 15, 2015, under the case number 15-12136.
