Indiana Limestone eyes plan extension to prosecute dismissal motion

Pittsburgh, June 17 – Victor Oolitic Stone Co., which does business as Indiana Limestone Co., requested an extension of its exclusive periods for filing and soliciting votes on a Chapter 11 plan, according to a Tuesday filing with the U.S. Bankruptcy Court for the District of Delaware.

Specifically, the company wants to extend its exclusive filing period to the earlier of the entry of a non-appealable order dismissing its bankruptcy case and Oct. 14 and the solicitation period to the earlier of the dismissal order date and Dec. 15.

According to the motion, the Indiana Limestone debtors are winding down their Chapter 11 cases and intend to file a motion to dismiss those cases.

However, given the upcoming expiration of the exclusive periods, the company said it filed the extension motion “to maintain the status quo while the debtors prosecute the motion to dismiss.”

Victor Oolitic Stone, an Oolitic, Ind.-based limestone quarry owner, filed bankruptcy on Feb. 17. The Chapter 11 case number is 14-10311.
