Spyker: Court grants GM motion to dismiss tortious interference claim

By Caroline Salls

Pittsburgh, June 11 - Spyker NV said the District Court for the Eastern District of Michigan granted General Motors' motion to dismiss Spyker and Saab Automobile AB's claim for tortious interference.

According to a news release, Spyker will assess whether to exercise its right to appeal upon review of the court's opinion, which is expected to be filed within the next two weeks.

As previously reported, Spyker filed a complaint against GM in August 2012 seeking redress for allegedly unlawful actions GM took to avoid competition with Spyker's 100% subsidiary Saab Automobile AB in the Chinese market.

Spyker said GM intended to drive Saab Automobile into bankruptcy.

Specifically, Spyker alleged that GM tortiously interfered with a transaction between Saab Automobile, Spyker and Chinese investor Youngman that would have permitted Saab Automobile to restructure and to remain a solvent, going concern.

According to an August 2012 release on the complaint, the monetary value of the claim is $3 billion.

Saab is a Trollhattan, Sweden-based car manufacturer.
